Dear Member of Congress,

As your constituent, I am writing to urge you to support the Subpoena Abuse Prevention Act (H.R.8966, S.4594), a bipartisan effort that would help protect Americans from invasive government demands for their private data.

The Subpoena Abuse Prevention Act would require a judge’s approval before the government can demand Americans’ phone call records. It would also prohibit the government from subpoenaing phone and tech companies to investigate Americans based on their speech or other constitutionally protected activities.

Under current law, the government has used administrative subpoenas issued without judicial oversight to spy on Americans’ private data in order to suppress constitutionally protected speech. Officials have targeted Americans who have criticized the government or documented public government action. They have also targeted journalists. The Department of Homeland Security, for instance, used an administrative subpoena to demand phone records of journalists Don Lemon and Georgia Fort, who were criminally charged for reporting on a protest in Minnesota.

Demanding Americans’ private data because they have exercised their First Amendment rights is wrong. I urge you to support the Subpoena Abuse Prevention Act and put a stop to the abusive subpoenas the government is using to spy on journalists and other Americans.
